Terms of Service

The University of Washington (“UW”) through its Integrated Design Lab (“IDL”) has created a comprehensive program centered on helping the healthcare industry move towards energy efficient goals. Part of this comprehensive program includes this informational website that provides information on how proper design and operations can cut energy consumption in the healthcare industry and features information about green architecture, high performance design, sustainable planning and infrastructure development (“Service”). The Service is subject to the University of Washington’s Terms of Use, The University of Washington’s Privacy Policy, and this Terms of Service. The Service is protected by copyright and/or other applicable law. Any use of the Service other than as authorized is prohibited. The University of Washington reserves the right to change or modify the Terms of Service at any time and in its sole discretion without notice to you. The full version of the Terms of Service are published in the T100 archive site. By using or accessing the Service you are legally bound by the Terms of Service. If you do not agree with the Terms of Service, you are not authorized to use this website.

Definitions

“Downloadable PDFs” means any and all downloadable publications, including without limitation, reports, leaflets, flyers, brochures, information sheets, handouts, and summaries.
“Entity” means the organization, partnership, limited liability company, corporation, or nonprofit that You are employed with.
“Commercial Use” means selling, reproducing, distributing, creating derivative works, publicly displaying, or publicly performing all or part of the Service in a manner that is primarily intended for or directed toward commercial advantage or private monetary compensation. For purposes of clarity, the internal use by You or the Entity of the knowledge obtained from the Service to help create a high performance design, green architecture, or sustainable plan does not constitute Commercial Use.
“Proper Attribution” means this copyright and trademark notice: “© 2012 University of Washington. All rights reserved. ‘Targeting 100!’ is a trademark of the University of Washington.”
“Purpose” means for the use by You and/or the Entity in order to plan, design, construct, and/or operate a healthier, more productive, energy efficient, and sustainable building.
“You” means the individual accessing the Service.
Grant. The UW grants You the limited, non-exclusive, royalty free, right to the following solely for the Purpose:

The right to reproduce the Service by printing copies of the screen You are accessing as long as it is not for a Commercial Use and includes Proper Attribution, the right to reproduce does not include the right to reproduce the Downloadable PDFs.
The right to reproduce the Service by saving a screen shot of it as long as it is not for Commercial Use and includes the Proper Attribution.
The right to distribute the printed copies of the Service (excluding Downloadable PDFs) as long as there is Proper Attribution and it is not for Commercial Use.
The right to publicly display the Service within the Entity as long as it is only to Entity employees or contractors and it is not for Commercial Use and includes Proper Attribution.
Restrictions.

You are prohibited from reproducing, distributing, modifying or otherwise creating derivative works, publicly displaying, or publicly performing the Downloadable PDFs. You hereby acknowledge and agree that your use of the Downloadable PDFs is subject to the separate agreement that is agreed to when downloading that specific Downloadable PDFs.

You acknowledge and understand that “Targeting 100!,” “UW,” “The University of Washington,” and its logos are all trademarks of the University of Washington and the Terms of Service does not grant any right to the use of the trademarks.
No Unlawful or Prohibited Use. As a condition of your use of the Service, you will not use the Service for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available through the Service.

Limitation of Liability. To the extent allowed by law, the University of Washington will not be liable for any damages whatsoever, including, without limitation, damages for loss of business profits, business interruption, loss of business information, or other losses, arising out of the use of or inability to use the Service, even if the University of Washington has been advised of the possibility of such damages.

Governing Law. Any claim arising under or relating to the Terms of Service shall be governed by the internal laws of the State of Washington, without regard to principles of conflict of laws. Any suit, action, or proceeding arising out of or relating to the Terms of Service will be decided in King County, Washington, and you accept and consent to the venue and jurisdiction of Federal District Court of Western Washington Seattle, or the King County Superior Court.

Severability. If any provision of the Terms of Service is declared void or unenforceable by a court of competent jurisdiction, such provision will be severed from the Terms of Service, and the balance of the Terms of Service will remain in full force and effect.

No Waiver. A waiver of a breach or violation of any provision of the Terms of Service will not constitute or be construed as a waiver of any subsequent breach or violation of that provision or as a waiver of any breach or violation of any other provision of this Terms of Service.

Entire Agreement. You agree that this Terms of Service constitutes the entire, complete and exclusive agreement between you and the UW with respect to the Service. The Terms of Service supersedes all prior agreements and understandings, whether written or oral, or whether established by custom, practice, policy or precedent, with respect to the subject matter of the Terms of Service.
